1. Overview

This website is operated by Selunyra, also presented as SELUNYRA FASHION HOUSE (“Selunyra,” “we,” “us,” or “our”). Throughout these Terms of Service, “Site” refers to https://selunyra.com, and “Services” refers to the Site and all related information, content, features, tools, products, customer support, and services offered by Selunyra.

Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you. Shopify is our technology provider and is not the seller of products purchased from Selunyra.

By visiting the Site, creating an account, placing an order, purchasing a product, or otherwise using the Services, you agree to be bound by these Terms of Service (“Terms”), together with any additional policies referenced in these Terms or made available on the Site.

If you do not agree to these Terms, you must not access or use the Services.

2. Eligibility and Use of the Services

By using the Services, you represent that:

You have reached the age of majority in your state, province, territory, or country of residence; or

You have reached the age of majority and have authorized any minor dependents under your supervision to use the Services.

You may use the Services only for lawful purposes and in accordance with these Terms.

You must not use our products, Site, or Services for any illegal, unauthorized, fraudulent, abusive, or harmful purpose. You must not violate any laws applicable to you, including intellectual property, consumer protection, privacy, export control, or ecommerce laws.

4. Product Information

We make reasonable efforts to display our products, photographs, colors, materials, dimensions, descriptions, availability, and pricing as accurately as possible.

However:

Colors and appearance may vary depending on your screen, device, lighting, and display settings.

Product measurements may have reasonable manufacturing or measurement variations.

Packaging may differ from images shown on the Site.

Product availability is not guaranteed.

We do not warrant that every product image or description will be completely free from minor errors.

Please review all product descriptions, materials, sizing information, care instructions, warnings, and available options before placing an order.

If you have allergies, sensitivities, or questions concerning product materials, please contact us before purchasing.

5. Prices and Payments

Unless otherwise stated, prices displayed on the Site are shown in the currency selected or displayed at checkout.

Prices, discounts, product availability, and promotions may change at any time without prior notice. A price change does not affect an order that we have already accepted, except where an obvious pricing or technical error has occurred.

You agree to provide accurate and authorized payment information. By submitting payment information, you represent that you are authorized to use the selected payment method.

Applicable taxes, shipping charges, duties, or other charges will be displayed or calculated where available during checkout. Your final order total will be shown before you submit your order.

Payment processing may be provided by Shopify Payments or other third-party payment providers. We do not directly store complete payment card details.

6. Orders and Order Acceptance

Submitting an order does not automatically mean that we have accepted it.

After an order is submitted, we may send an acknowledgement or confirmation email. We reserve the right, where permitted by law, to accept, reject, limit, or cancel an order for reasons including:

Product unavailability;

Incorrect product or pricing information;

Suspected fraud or unauthorized payment;

Shipping restrictions;

Unusually large quantities;

Resale or unauthorized commercial activity;

Violation of these Terms; or

Circumstances beyond our reasonable control.

If we cancel an order after payment has been successfully processed, we will issue a refund to the original payment method.

You are responsible for checking your order information, including product selections, quantities, billing information, shipping address, and contact information, before submitting your order.

Please contact support@selunyra.com as soon as possible if you need assistance with an order. We cannot guarantee that an order can be changed or cancelled after processing or shipment has begun.

7. Promotions, Discounts, and Gifts

Promotional offers, discount codes, sale pricing, gifts with purchase, and other special offers may be subject to separate conditions, eligibility requirements, availability, minimum purchase amounts, exclusions, and expiration dates.

Unless expressly stated otherwise:

Promotional offers cannot be combined;

Discounts have no cash value;

Promotions are available while supplies last;

Returned items may affect eligibility for gifts or promotional pricing; and

We may correct, suspend, or end a promotion where there is an error, abuse, fraud, or other legitimate reason.

8. Shipping and Delivery

Shipping destinations, charges, processing times, estimated delivery times, tracking procedures, and other delivery information are described in our Shipping Policy:

Delivery dates are estimates and are not guaranteed. Delays may occur due to customs processing, carrier disruptions, holidays, weather, incorrect addresses, local delivery conditions, or other events outside our reasonable control.

You are responsible for providing a complete and accurate shipping address. We are not responsible for delivery problems resulting from information supplied incorrectly by the customer, except where applicable law provides otherwise.

Risk of loss and ownership of purchased products pass in accordance with applicable law and the delivery arrangements for your order.

9. Returns, Exchanges, and Refunds

Returns, exchanges, damaged or incorrect products, non-returnable items, and refunds are governed by our Refund Policy:

Our currently published Refund Policy provides a 30-day return period, subject to its eligibility requirements and exceptions.

You must contact us before sending a return. Items returned without first submitting a return request may not be accepted.

Nothing in these Terms limits any mandatory cancellation, return, refund, warranty, or consumer rights available under applicable law.

10. Personal and Commercial Use

Products purchased through the Site are intended for personal use unless we expressly agree otherwise in writing.

We may limit or refuse orders that appear to be placed by dealers, resellers, distributors, or other unauthorized commercial purchasers.

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal shopping and other lawful, non-commercial purposes.

Without our prior written permission, you must not:

Copy, reproduce, distribute, republish, display, or sell Site content;

Use our trademarks, logos, product images, or branding;

Modify, reverse engineer, scrape, or create derivative works from the Site;

Remove copyright, trademark, or ownership notices; or

Use Site content for artificial intelligence training, automated collection, resale, or commercial databases.

12. Reviews, Feedback, and User Content

If you submit a product review, photograph, comment, feedback, suggestion, or other content (“User Content”), you represent that:

You own or have permission to submit it;

It is accurate and based on your genuine experience where applicable;

It does not violate another person’s rights;

It is not unlawful, misleading, defamatory, discriminatory, threatening, obscene, or harmful; and

It does not contain malware, unauthorized advertising, or confidential information.

You grant Selunyra a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate, display, and distribute your User Content in connection with operating, improving, and promoting the Services, subject to applicable law and our Privacy Policy.

We may moderate or remove User Content that violates these Terms, but we are not obligated to monitor all submissions.

13. Prohibited Activities

You must not:

Use the Services for unlawful or fraudulent purposes;

Submit false or misleading information;

Infringe intellectual property, privacy, publicity, or other legal rights;

Harass, threaten, abuse, or discriminate against another person;

Upload malicious code, viruses, or harmful technology;

Attempt to gain unauthorized access to the Site, accounts, systems, or networks;

Interfere with the operation or security of the Services;

Scrape, crawl, harvest, or automatically collect Site data without permission;

Circumvent security features, purchase limits, or access restrictions;

Use another person’s payment information without authorization;

Place fraudulent orders or abuse returns, promotions, discounts, or chargebacks;

Impersonate another person or misrepresent your identity; or

Use the Services in a manner that could damage Selunyra, Shopify, our customers, or third parties.

We may suspend or terminate access to the Services for violations of this section.

Third-party services are controlled by their respective providers and may be subject to separate terms and privacy policies. We are not responsible for the content, availability, security, accuracy, or practices of third-party services, except to the extent responsibility cannot legally be excluded.

Your use of third-party services is at your own discretion and risk.

If these Terms conflict with the Privacy Policy regarding the collection, processing, or disclosure of personal information, the Privacy Policy will control.

When you place an order, create an account, contact us, or otherwise use the Services, you consent to receive electronic communications related to your transactions, account, customer service requests, and the operation of the Services.

Marketing communications will be sent in accordance with applicable law. You may unsubscribe from promotional emails by using the unsubscribe link provided in those emails. Unsubscribing from marketing messages will not prevent us from sending necessary transactional or service-related communications.

To the fullest extent permitted by applicable law, Selunyra and its owners, employees, affiliates, contractors, service providers, licensors, and representatives will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including loss of profits, revenue, data, goodwill, or business opportunity, arising from or related to:

Your use of or inability to use the Services;

Products purchased through the Services;

Third-party services or links;

Unauthorized access to your account or information; or

Errors, omissions, interruptions, or delays affecting the Services.

Where liability cannot be excluded, our liability will be limited only to the maximum extent permitted by law.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, personal injury, death, or any other liability that cannot legally be excluded or limited.

20. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Selunyra and its owners, affiliates, employees, contractors, service providers, licensors, and representatives from third-party claims, liabilities, damages, losses, and reasonable expenses arising from:

Your material violation of these Terms;

Your unlawful or unauthorized use of the Services;

Your violation of another person’s rights; or

User Content submitted by you.

This section does not apply to the extent a claim resulted from Selunyra’s own unlawful conduct, negligence, or breach of these Terms.

21. Termination

These Terms remain effective until terminated by you or us.

You may stop using the Services at any time. We may suspend or terminate your access if we reasonably believe you have violated these Terms, engaged in fraud or abuse, threatened the security of the Services, or caused harm to Selunyra or another party.

Provisions that by their nature should survive termination—including intellectual property, payment obligations, disclaimers, limitations of liability, indemnification, and dispute provisions—will remain in effect.

22. Governing Law and Disputes

These Terms are governed by the laws of the State of California and applicable federal laws of the United States, without regard to conflict-of-law principles.

To the extent permitted by law, disputes arising from these Terms or the Services will be subject to the jurisdiction of the appropriate courts located in California.

Before filing a legal claim, you and Selunyra agree to make a reasonable good-faith effort to resolve the dispute by contacting the other party and providing sufficient information about the issue.

Nothing in this section limits any mandatory consumer rights, protections, remedies, or jurisdiction available to you under the laws of your place of residence.

23. International Customers

Customers accessing the Services from outside the United States are responsible for complying with the laws applicable in their jurisdiction.

These Terms do not limit mandatory consumer rights that apply in your country or region. If a provision of these Terms conflicts with a mandatory consumer-protection law, the mandatory law will apply to the extent of the conflict.

24. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or removed to the minimum extent necessary. The remaining provisions will continue in full force and effect.

25. No Waiver

If we do not immediately enforce a provision of these Terms, that does not mean we waive our right to enforce it later.

A waiver is effective only if made in writing by an authorized representative of Selunyra.

These Terms and the policies referenced in them constitute the entire agreement between you and Selunyra concerning your use of the Services and supersede prior communications or understandings concerning the same subject matter.

Any ambiguities in these Terms will not be interpreted against a party solely because that party prepared the text.

27. Changes to These Terms

We may update these Terms to reflect changes in our Services, business practices, policies, technology, or legal obligations.

The revised Terms will be posted on the Site with an updated “Last updated” date. Where required by law, we will provide additional notice.

Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms, except where applicable law requires another form of consent.
